| Tartalmi kivonat: | When we want to turn our attention to neo-Durkheimian thoughts about the sociology of law it has to be examined those contemporarily researches that have empirically tested the connection between the morality and law. Concerning the relationship between law and morality we can see Lonn Lanza-Keduce (and other scholars as well) studies what is the connection between the society’s moral thinking and the criminal law. As the outcome pointed out the members of society have higher degree of knowledge of criminal law and less degree about constitutional law and lesser about the civil law. After that it has to be seen logical to consider Kai Ericson’s study about the so-called Wayward puritans. In that situation they demonstrate how could work the punishment in order to maintain the solidarity of community. Albert Bergesen pointed out (on the basis of Durkheim and Ericson) haw to use an unconventional deed or deem could turn into a political crime: the more society1s moral order in infused with political connotations the more ordinary crime is regarded as political. Next, it has been discussed Durkheim’s ideas about legal evolution and the division of labour and the connection between above motioned and social complexity. So, we examined Richrad D. Schwartz, James C. Miller, Steven Spitzer és Michel Clarke studies and parallel to that the weaknesses of the idea about the repressive law and restitutive law. Finally, we attempted to learn the problems of Durkheim’s methodological processes. |
