Pursuant to Chapter XXI, Section 300 (1) of Act CXXX of 2016 on the Code of Civil Procedure (hereinafter referred to as the „Code of Civil Procedure”), „An expert shall be engaged if special expertise is required to determine the scope of the dispute or to establish or assess a fact of significance in the dispute.” In court proceedings, questions of fact and law may arise and the subject of the expert's opinion is always some kind of factual finding. Scientific and technical knowledge is of crucial importance in all aspects of human life, including the various areas of law enforcement. Although, as a rule, the principle of freedom of proof applies in the various proceedings, it is undoubtedly the duty of the expert to establish facts requiring special - scientific or technical - expertise. The safeguards for expert opinions, which I have briefly described in this study, ensure that they meet the quality criteria and provide control over the expert's work Although the court does not have the necessary professional competence to answer the technical question raised when appointing the expert, these safeguards help the court to decide, in the first instance, whether the expert opinion can be considered as evidence when assessing the expert opinion. Although one of the main guarantees of quality is the person and competence of the expert, in which the appointment, training and registration of experts in the relevant fields of expertise are important, it is nevertheless often the case that the expert gives an expert opinion which raises concerns. The safeguards for expert opinions apply equally to opinions given by seconded experts, private experts and experts seconded in other procedures. If the conduct of the expert examinations on which the expert opinions are based complies with these safeguards, the court's judgments may be based on reliable evidence which is well founded in the case.
