Tartalmi kivonat: | In this study I attempt to work those intellectual entrepreneurs who have gone further in the analyses of law of Karl Marx and Friedrich Engels. The Marxian perspective on the legal sociology was that the law is used by the ruling classes to their advantage and to suppress the subordinates. As the title of this work is represented now the attention has been turned to the writings of neo-Marxist scholars like Jevgenyij Pasukanis, Isaac D. Balbus,Karl Renner, and Alan Stone and their attempts to formulate the legal theories and sociological perspectives within the Marxian perspective. Pasukanis argued – as Marx said – that there exists a parallel between the logic of commodity form and the logic of the legal form. While he predicted the law would wither with the complete elimination of the bourgeoisie Isaac Balbus developed Pasukanis thesis, and in his point of view the law may be described as having a relative autonomy. Later Karl Renner postulated the legal norms could change but their structures would nevertheless remain the same. He saw the socialism as an economic system that is conscious of itself. Finally Alan Stone’s view on the law: the specific rules may be questioned time after time but the legitimacy of the essential legal relations is almost never questioned. To sum up, this work has tried to give a comprehensive overview in sociology of law after Marx and Engels in the most important theoretical orientations. Finally, it can be said that the theories are more further from the Marxian’s view of sociology of law in time theoretically the greater distance can be found between economy and law moreover the various social spheres have greater autonomy as well. |
