The fundamental question is whether the defendant should be punished when he is proven to be a psychopath, considering the fact that psychopathy is a mental disorder the defendant cannot be blamed for, but it deprives him of the ability to recognize the moral weight of his act. This article attempts to analyze the problem by focusing on the system ojf the purposes of criminal punishments, pointing out that the characteristics of psychopathy restrict the fulfillment of these purposes. |
