Tartalmi kivonat: | Good offices is one of the peaceful means of dispute settlement, which has nowadays gained increased importance in the life of the international community. For the examination of good offices besides international law it's inevitable to take into consideration politics, history and international relations. This is one of the oldest methods of providing help for the settlement of international disputes by a third party, had already been performed among the ancient Greek city-states. Since the 1700s we know more about good offices, as several international treaties contained regulations of it. Following the history of good offices the author provides its definition, and highlights its wideness within the legal and practical context of the 21's century. Originally good offices has only been applied in case of disputes among states, but today it's frequent when dealing with intra-state conflicts. Good offices has a significant role in protection of human rights, refugees, women, children, prevention of epidemics, etc. Although in practice an overlap is existing between good offices and other peaceful means of dispute settlement, the author expressly defines the differences, limits. The article elaborates the advantages of good offices, such as absolute respect for the sovereignty of the states. When comparing the advantages and disadvantages, the author takes into consideration the relevant global and regional factors. A significant issue in relation to good offices is the person of the envoy, thus the author outlines in detail the general questions in respect of the international organizations and envoys who provide good offices. Numerous examples serve as confirmation of the statements and conclusions of the author. The article answers the theoretical, legal and practical questions of good offices. |
