| Tartalmi kivonat: | The study gives an introduction about the nature and basic types of alternative dispute resolution (ADR) and a comparison about the factors, which could influence the spreading of ADR in the United States and how these factors developed in Hungary. ADR has a history in the United States of America. It's first aim was to resolve disputes between labour and management by mediation in the early 20t1 From the 1970-s ADR started to spread and by nowadays it is popular in several fields like resolving family, business, labour, consumer and neighbour disputes. Being the new dispute resolution methods so popular had more reasons. The general individualism of the American society, the courts terribly overwhelmed with files, the adversary and public nature of trials and the seek for faster, cheaper but efficient private resolution combined with the openness of lawyers led to the introduction of the ADR methods on a broad scale. The new, modern methods of ADR recently appeared in Hungary in the forms of mediation and arbitration but the new ways of settling disputes are hardly known and rarely used. Due to the different political, economical and social past, the different (non anglo-saxon) judicial system and education a slower spreading can be predicted to the application of ADR. On the other hand, many kinds of disputes can be resolved by the means of these methods other than potential lawsuits in front of the court. Family, neighbour, labour and business disputes has the same or similarly sensitive nature everywhere. These can be the potential fields where ADR can be a possibility to get amicable resolutions. |
