Tartalmi kivonat:My research focused on the so-called “three strikes laws” in the Hungarian Criminal Code. These sanctions – inspired by the similar rules in the United States and Slovakia – were introduced in the Hungarian sanctioning system in 2010, making sanctions for multiple violent recidivists and for concurrence of offences much stricter. In the first major part of my work, I give a short overview on the legal tools that Hungarian criminal law tried to use against the recidivists. Then I examine the “three strikes” legislation in the former and in the current Criminal Code. In the second part I examine whether these extremely severe sanctions – especially the mandatory life sentence – are conform to the provisions of the Hungarian Fundamental Law and to the basic principles of the Hungarian sanctioning system. In this examination I use the opinions of competent legal scholars and practitioners and the relevant practice of the Hungarian Constitutional Court, especially the judgement that dismissed the “three strikes” in case of concurrence of offences. I also examine the case law of the European Court of Human Rights on the real life imprisonment, and the answer of the Hungarian legislature on this issue. In the last major part, I analyze 40 concrete cases from the Hungarian jurisdiction searching for the problems and controversial points in the appliance of the “three strikes” law. Finally I give a brief summary on this controversial issue. I also draft a proposition for the legislature that, in my opinion, is able to fulfil the goals of the criminal policy and provide the constitutionality of the “three strikes laws” at the same time.
