Tartalmi kivonat:The Data Protection Directive of the European Union has two main goals: the protection of individuals with regard to the processing of personal data and on the free movement of such data. It is difficult to find the balance between the two goals of the Directive for the legislation of the Member States and even for the Court of Justice of the European Union: it is the balancing between the fundamental rights and the “four freedoms”. The most important cases of the Court are introduced in my study from the point of view of the data protection. The protection of individuals with regard to the processing of personal data clashes with fundamental rights like freedom of data, freedom of expression. The history of the drafting of the data protection directive can help in the interpretation of its measures: the protection of the rights of the individuals was more important in the developing of the data protection regime of the Community and it is becoming more important in the practice of the Court.
