| Tartalmi kivonat: | The European order for payment procedure protest lodged against a payment warrant and in the Hungarian law regulated protest lodged against a payment warrant of the same substantive eventuates completely different legal effects (dissmissing of the proceeding and the proceeding becomes civil process/civil lawsuit). Civil proceeding (civil lawsuit) begins or continues on different and different grounds after the payment warrant proceeding according to the European Union law and the domestic (of legal force/effective) law. The study – focusing on the context of the Hungarian effective/ of legal force law – tries to draw the inference in the small claims proceeding and in the civil procedure of general rules. On the other hand the defendant has got very important aspects on the basis of different dates of the defendants initial appearance on the court. The unavoidable aspect is whether the contradiction of the defendants (obligors) is the same as the counterclaim lodged by the defendant identical or as the initial appearence of the defendants. Further point of view can be the fact that the delivery of the statement of claim has got the same effect as the delivery of the payment warrant by service of process. When examinig this issue however, further interesting analogies might break surface between the rules of the payment proceeding and the small claims procedure. |
