Tartalmi kivonat:The Constitutional Court of Hungary started first among the new institutions of the rule of law. The first five justices of the CC were elected by the Parliament on November 23, 1989 and the constitutional justices held their first session on January 2, 1990. The CC enjoyed a great freedom in determining its position in the constitutional structure, including its political weight and role and also the legal competence in its qualified sense. The creators had rather ambiguous ideas about the functions of a constitutional court and the role it should play in the process of political transition. The historical circumstances therefore had a strong influence and determined in principle the set up of the new institution. The paper explores how some of the competences of the Court have been interpreted and developed in constitutional jurisprudence.
