Tartalmi kivonat:In this essay I examined the effectiveness of the public authorities in the election campaign. The scope of the research can be divided into two main parts: (i) on one hand, the relevant fundamental rights protection in the election campaign regarding the legislation and the public information throughout the election period. In connection with legislation, I differentiated between guaranteeing general equal opportunity and its special field: the provision of the press. (ii) On the other hand, this essay aimed to assess the jurisprudence of the Hungarian Constitution Court, the Curia and the National Election Committee under the new Act XXXVI of 2013 on Electoral Procedure (hereinafter: Ve.). This part of the research can be split into two parts: (ii)/i. the connection between state neutrality and the requirement of balanced and impartial reporting; furthermore (ii)/ii. the differentiation between informing constituents as a public authority during electoral period and campaigning with the use of this position. On the latter, the jurisprudence of the Curia took an unexpected turn due to the amendment of the Ve., thus the question arises whether the guarantees, which were developed in the earlier case-law, can be upheld after the amendment. In order to prove the necessity of upholding, I established a framework for interpretation, taking into account the consistent jurisprudence of the German Federal Constitutional Court. Finally, the question arises whether state neutrality can be interpretated as a constitutional value and what arguments are there for this way of interpretation.
