Tartalmi kivonat: | In the Hungarian law the executive officers of the co-operative are the president and members of the management. Their office come into being by election or by acceptance of their assignment. The office may be occupied on the basis of agency contract (Civil Code contains the releated rules) or employment relationship (Labor Code contains the releated rules). The executive officers have to carry out their job by increased degree of attention. In that case, if the laws, bylaws or adopted rulings of the general meeting is offended during their activity and as a result they couse any harm to the co-operatives, they are for the responsible it upon the regulation of civil law. This rule can be applied even in that case if they are in employment relationship with the co-operative. Their liability is joint and several liability. The paper presents, if the rules of joint and several liability of civil law can be implemented in the practice of co-operative law, and if so, in wich way. |
