Tartalmi kivonat: | The Hungarian Parliament passed a new unified antidiscrimination act on promoting the equal treatment and equality of the chances after long debates in December 2003. Before it the Hungarian regulation was realized in a more level system which was characterized by the articulation of legal branches. The constitutional provisions were mainly contained in codes of substantive law and procedural acts and are also already contained is them conforming to the rules of the new act. However this model didn't form any unified system on more reasons. In the Hungarian legal system many legal dispositions prohibited the discrimination before 2003 as well but they didn't define it anywhere. (Only the Labour Code determined the prohibition of indirect discrimination after the acceptance of the European Union norms in 2001.) So it is the Hungarian Constitutional Court's task — starting from the right of the human beings' dignity — to detail the most important conceptual elements of the Hungarian Constitution's Article 70/A with its decisions. The present study demonstrates in its sections the most important decisions and theirs most important statements which are in connection with the equal rights, discrimination, giving preferences (positive discrimination) and generally with equal treatment. Significant part of them — besides the international norms — presented basis for the conception of the unified act. Of course this study didn't loose its seasonality, because the knowledge of the Hungarian Constitutional Court's practice is essential currently as well for the judgment of the rules concerning equal treatment. |
