| Tartalmi kivonat: | Article 15 of The Constitution of the Republic of Hungary declares ’The Republic of Hungary shall protect the institution of marriage and family.’ Within Article L the new Fundamental Law of Hungary gives a bit wider phrase when it states; ’Hungary shall protect the institution of marriage as the union of a man and a woman established by voluntary decision, and the family as the basis of the nation’s survival.’ The currently valid Constitution talks about family protection quite reticently, but there are several other ways to know and learn more about family protection; there is the Child Protection Act XXXI of 1997 on The Protection of Children and Guardianship Institution, the United Nations Convention on the Rights of the Child, 20 years of practice and technical literature of the Constitutional Court and the experience how the family protection system has worked in Hungary previously. In my presentation I would like to highlight that in the past 20 years how did the concept, the function and the composition of the families change; and compare to this how practical is to have a quite certain definition in the new Fundamental Law; and the impact of this direction on the state subventions for families. In this matter I may only rely upon the news of the press, the private judgement’s of experts and on my own opinion, since by the time of the conference neither the new act on family protection was seen by the Parliament nor the bill was published. In my presentation I tried to give an overview what should have been the main intentions of the founders to have this new definition, and what will be the result of it? |
