Tartalmi kivonat:The pressure-ridden 25 April 2011 adoption of the Hungarian Fundamental Law gave the idea to map the attributes of the “nation” concept in Hungarian constitutional thought and regulation. Analysis shall be conducted from a comparative constitutional legal and international legal point of view, complemented with the examination of political, cultural and ethnic aspects as well, because these approaches orient the outcome of any legal examination. As Ignácz Kuncz a legal thinker of the early 1900s stated: the “legal element” is only the outer frame of the active development of a nation-state. In present paper Author discusses the content of relevant Council of Europe Recommendations and Venice Commission documents in relation to the preamble and the normative text of the new Hungarian Fundamental Law contouring the interpretation and selfdetermination of the nation. In looking ahead, the paper also discusses new dilemmas arising in terms of the Hungarian diaspora living as a minority in e.g. neighboring states and touches upon the question of out-of-country voting attached to the acknowledgment of plural citizenship in recognition of the multi-layer identity that expatriate Hungarians possess especially in the neighboring countries.
