Tartalmi kivonat:The principle of the rule of law includes, among others, the legality of exercising public power. One of the instruments of the legal control over the administration is the court review of the decisions of the administration. Therefore, the author places the administrative jurisdiction in the ideology of the rule of law, and points out the relationship between them. As a background, the author draws up the history of administrative jurisdiction, including the Hungarian Royal Administrative Court that was established in 1896, and eliminated in 1949, furthermore, the regime introduced by the Et. (Act IV of 1957) and Ae. (Act I of 1981). Then he refers to the constitutional amendment of 1989 and the jurisprudence of the Constitutional Court. The regulations in force are detailed, and the provisions of the new basic law are analyzed by the paper, and also the division of powers between the Constitutional Court and the Administrative Court, as well as the basic questions regarding the organization and the competence of the administrative courts are examined. Finally, proposals are made regarding the possible future development, in order to improve the system of administrative jurisdiction.
