Tartalmi kivonat:My article deals with the term „activism” applied during the evaluation of the activity of a constitutional court. The reason of writing it lies in the largely indefinite meaning of the expression, and the need to arouse the claim of applying it with a clarified meaning during a scientific survey of the jurisprudence of a body performing constitutionalé adjudication. I restrict my scrutiny to the meaning of the term as applied to the relation of a constitutional court and the legislative power. I rely primarily on the literature of the United States (where this problem was raised earlier), particularly the distinction of Keenan M. Kmiec. I examine the problems and pitfalls of two possible definitions of activism, namely „striking down arguably constitutional actions of other branches”, and “ignoring precedent”. As to the first, I conclude that this definition really makes any sense only by referring to „arguably constitutional”, that is, reasonably debatable cases, and that it still ignores the possibility of activism by upholding certain actions of other branches. As to the second, I find it problematic that even a long-followed precedent itself can be deemed „activist” either by this very definition, or by other criteria. I illustrate my point with American and Hungarian constitutional decisions.
