Tartalmi kivonat:The several amendments to Act IV of 1978 disintegrated the structure of the Criminal Code andso the legislature has enacted the Act C of 2012 on the Criminal Code to restore proper structure. The most comprehensive reforms have affected Chapter XIX of the Criminal Code called „Offences against sexual freedom and sexual morality”. These changes are significant in both formal and substantial aspects. The offences against sexual freedom and sexual morality are amongst the socially most disapproved crimes. It especially applies to sexual offences against children. In my paper, I deal with problems of subsumption of sexual violence against children. My main purpose is to reveal problematic issues by the method of making comparison between the application of law and the opposite views expressed in legal literature. I pay special attention to the consensual form of sexual violence against children under twelve because its regulation technique in the Criminal Code has undergone significant changes. This is causing a serious challenge to legal literature and law application as well. The dilemmas revealed in legal literature are appearing in law application. In my paper, I analyse some problematic anonym decisions, which reflect the wrong methods of interpretation. I draw the conclusion that the relevant Curia Decision 2/2016 for the Unified Interpretation of Criminal Law does not conform to the constitutional requirements on criminal law. As the conclusions of my research, I give de lege ferenda recommendations to resolve the interpretative anomalies of court practices.
