Tartalmi kivonat:In this essay I have attempted to discuss the key concepts of conflict theories contrasting the basic tenets of structural-functionalism. I wanted to show the general description of conflicts in society concerning the law and the connection between the social conflicts and the law. Furthermore I tried to examine what kind of role the dissensus and competition play in the society and in the legal sphere. A few theorists have been considered (like in the beginning Georg Simmel or Lewis Coser) and trough their statements I wanted to make more visible what the conflict’s problems in society cause any effect on the law or the legal system. After that first of all within the criminology the legal historical facts could be considered trough the criminal theories (for instance: Thornsten Sellin, George Vold, Richard Quinney, Jerome Hall, Willliam Chambliss). Parallel to above mentioned some status questions came up such as the prohibition (temperance movement) and drugs questions (Joseph Gusfield, Troy Duster). Finally it must be considered the mixture of conflicts theories and the functional/dysfunctional problems in society (Austin Turk). One question has been come up: the importance. And the answer: the power of law and the cultural, economic, political, etc. power behind the law and our legal system.
