Tartalmi kivonat:From 1st January 2012 the Fundamental Law of Hungary contains that „[a]dult children shall be obliged to take care of their parents if they are in need.” Notwithstanding that the Hungarian legal system has contained rules on maintenance of relatives and within this the maintenance of parents. In my study I am examining whether this rule of Fundamental Law is a real solution to an old, and well-known but unregulated question of elderly care. Elderly care is the complex entirety of mechanisms associated with maintaining the capacity of self care or compensating for the partial or total lack of the capacity of self care, resulting from old age, provided, for or in the interest of an elderly person with the purpose of helping him or her stay in his or her home or in home-like circumstances as long as possible. I am looking for the answer whether the subject of current legal situation has changed with the rule of Fundamental Law, whether this obligation is amenable to law in practice or is based only on material responsibility or makes any personal care responsibility. At present there is no separate structure for elderly care in Hungary. The current benefits and rules of elderly care in the Hungarian legal system, represent a solution to the problem of elderly care only in their effect and not in their aim.
