Tartalmi kivonat:Lately, in Hungary thousands of people were involved in proceedings concerning expropriation in connection with the rapid development of the road-network, the construction of motorways and with the realization of settlement-development objects. Accordingly, the chosen subject was not only ct rrent at the past but it is also highly current at the present. The subject is also current from the aspect that the Statutory Rule on Expropriation, which is being in force for around thirty-four years, was overruled by the legislator and a new Act, which is suitable for the present social and economic situation, was created. This act, Act CXXIII of 2007 on Expropriation, has entered into force on 1 st of January, 2008. This study aims to present the new characteristics and the theoretical and practical issues of this Act. In comparison with the previous regulation the provisions of the new Procedural Act on Expropriation and on Public Administration provide much more transparent and clearer view on the substantive and procedural regulation and execution of the expropriation. It is expectable that the objections mentioned in the study are going to appear in the law enforcement. Very little time has passed since the new act on expropriation has entered into force so it is hardly possible to analyze the observations on practical examples and to reach essential conclusions; to this, according to my opinion, much more time has to pass - mostly because of the small number of the decided court cases concerning expropriation.
