| Tartalmi kivonat: | The paper is dedicated to the examination of the quality of penal judgements by the criteria indicated in the title. The author points out that the role of finding the truth in criminal proceedings and the justness of sanctions imposed on the perpetrators of crime have been issues dealt with more by legal philosophers than by scholars of criminal law through a long period of time. In the second half of the 20th century in Hungarian legal writing the interest of proceduralists turned towards those issues. Some authors published books discussing the fundamental questions from the perspective of the law of criminal procedure. The paper shows that determining the truth is the basis of delivering a fair decision. The justness of the decision relates to the imposition of the sanction in proportion with the gravity of the perpetrated crime. The lawfulness of the application of substantive and procedural law is indispensable for the justness of the decision of the court. |
