Both the Hungarian and Italian systems are based on the canon law of the Roman Catholic Church, but Italian matrimonial law shows a closer connection with canon law, as some of its essential rules, thanks to the Lateran Conventions, are completely identical. Unlike Hungarian matrimonial law, optional civil marriage is accepted in Italian matrimonial law, i.e. the state recognizes marriages contracted by the Roman Catholic Church as valid for the state. This is a significant difference compared to the Hungarian legal system, since in Hungary only purely civil marriage is valid from the point of view of the state. In my study, I take a look at the steps of entering into marriage: the pre-marriage procedure and the Hungarian and Italian forms of marriage. Hungarian matrimonial law recognizes only one form, and considers ecclesiastical marriage as a separate but non-existent marriage from the point of view of the state, while in the Italian system, purely civil, concordats, marriages contracted by other churches and contracted in special situations are also known. The aim of my study is to broaden the legal thinking and to broaden the insight into the legal systems of the individual states, for which I use the method of comparison of laws.
