The benchmark of a modern state is to promote democracy, rule of law, human rights and minority rights. In international treaty law exists a legal institution, called reservation. By a reservation a state is allowed to modify or exclude a certain provision of a treaty, so they can limit some of their obligations. By this, the fundamental human rights can be excluded from these treaties, which means that those rights can not be prevailed in that country. In my thesis, I presented practices of variant international organizations regarding to reservations including League of Nations, Pan-American Union, and etc. Moreover, as I examined different treaties, it can be seen that many countries – including countries that follow sharia law – prefer to use the institution of reservation. The mentioned conventions – ICCPR, ICESCR, CEDAW – allow the states to make reservations and thereby many human rights can not be recognized. Furthermore, state parties have the right to object a reservation, but they can not be forced to withdraw their statement. Following a throughout research, it is obvious that, state parties often exercise their right to make reservations, even though those declarations are not compatible with the purpose of the treaty. Due to the reservations the global minimum of human rights are very low.
