The basic elements of social control are the micro and macro social ties, which deter the individuals from committing a criminal offence. It also emphasizes the value of reintegration and informal social care. These constitute the theoretical background of restorative justice, which is more and more promoted nowadays. The tools of restorative justice focus on the compensation of the victims and the rehabilitation of the offenders with the help of the community. There are different way to implement the idea of restorative justice in the criminal justice system, it can be regulated as an alternative to criminal procedure, or as one element of the proceeding. It has also relevance according to the sentencing stage and also related to the execution of the criminal sanctions. Restorative justice could encourage the constructive disputes within the society without transferring the arguments to the state level. However this is a promising concept we need to be aware of the danger of its over usage.
