Tartalmi kivonat:In the development of diplomatic law, there exists a legal institution accepted and practiced mostly in Latin-America but the diplomatic asylum has divided the international community since the second half of the 20th century. The Latin American political culture makes diplomatic asylum to be practiced by instituting its legal norms and principles in regional conventions. Most states in Latin America grant a person asylum at diplomatic premises by referring to the articles and rules of Havana or Caracas Conventions. Since the judgments of the International Court of Justice in the Asylum and Haya de la Torre cases, there have been many other examples of diplomatic asylum in Latin America that show the legal aspects of this “right” and fill the gap of the codification failure of this institution. Besides historical examples it is important to show the equivalent characteristics of the Latin American cases, to identify the legal opportunities of the territorial states after diplomatic asylum has been granted, and to reveal contradictions that constitute and influence the future of diplomatic asylum.
