But what is the meaning of the good state, how to connect the paradigm of rule of law with the „goodness” of the state, the protection of human rights, and how to affect the insurance and enforcement of the human rights institutions. There are many approaches to define the good state in the technical literature. 40 In spite of the variants, all the main terms are agree that one of the basic condition of the good state is to guarantee the success of the rule of law. And the key factor of the rule of law’s guarantees is the insurance and enforcement of human rights. The purpose of the study is to present the methods and instruments of measures on human rights and I would like to bring into connection with the paradigm of good state. First I do researches on international methods and present the international and European Union control mechanism for measures on human rights. I’m going to analyse the legal and political standpoints and the statistical data used to demonstrate the rankings between the states. I would like to describe in detail the international and European normative and institutional system of legal remedy - in consideration of the Hungarian practice. I pay particular attention to the Universal Periodic Review (UPR) and the Human Rights Indicator, as well as ranking Hungary in accordance with the success of human rights. The result of my study is the proof that the normative and institutional guarantees of human rights have high-priority. Through these guarantees could be determined the elements of rule of law and ranked the legal systems of the states.
