Tartalmi kivonat:The investigating part of the criminal procedure does not require the defendant in his/her person. For this reason it is possible to conduct the investigation even if the person of the perpetrator is unknown. But at the trial, the attendance of the accused concerns human rights aspects and guarantees, hence the procedure (trial) in absentia can be only an exemption. In my study, I’m searching answers for two questions. Firstly, I looking for the answer what tells that, how the principle of immediacy can prevail in a proceeding where the accused person is absent? (Or I can ask the question in another way: Does the principle prevail in these proceedings anyway?) Secondly, I am looking for the answer what is that: Is the above-mentioned process makes a faster criminal procedure? The study shows that we shall not forget that further widening in the law of the application of the special procedure (the Procedure Against the Non-Attending Defendant) serving the simplification and acceleration of the proceeding, might have a changing effect on the whole criminal procedure, its system, in the sense that the theoretical, regulatory and structural differences between the regular and the special procedure (the Procedure Against the Non-Attending Defendant) would weaken or fade away.
