Tartalmi kivonat:This paper considers the regulation of dismissal. In this study certain questions are considered in connection with the regulation of dismissal in Hungary examining on the one hand why and to what extent these regulations on dismissal in the different legal relations differ from each other in the light of the specific terms, on the other hand why the regulations of dismissal — although they completely meet the EU requierements — give an opportunity for their circumvention even today. The first part of this paper deals with the definition of dismissal by marking it off from the other forms of downrising an organization's staff. Following this, the subjects of mass layoff are going to be defined, in the frames of which we go into the details of the dimensions of the cutback plan that helps the transparency of layoff. Then we analyze the view-point system of the selection of employees. The second part of the study deals with the regulation of dismissal. At first, we show the ILO agreement and recommendation on the termination of employment, and the European Community directives on dismissal. The second chapter of the third part analyzes the Hungarian regulations and rules of procedure of the dismissal by looking at the different employment relations, analyzing the differences between these regulations, as well as whether these differences in regulations have advantages or disadvantages for the employees in any of the employment relations. ,\ ealso show the tools that can extenuate the consequences of dismissal. Finally, this is followed by the discussion of — as we consider — deficiencies of the Hungarian regulation.
