Tartalmi kivonat: | The aim of this study is to list and categorise the normative and other characteristics of fraudulent contracts. The subject of this research was the study of the legal practice for fraudulent transactions and the analysis of the relevant dogmatic and jurisprudential background. As a result of this analysis, the paper categorises the objective and subjective elements of fraudulence and then groups the features that generally accompany fraudulence, yet still not considered as key characteristics. The study highlights the internal legal factual elements of defective intention, wilfulness, bilateralism and privity as subjective features and describes their decisive nature in identifying fraudulence. At the same time, the paper places similar emphasis on the importance of misrepresentation as an objective element of legal fact. As a summary, the author provides the readers with a definition that covers the main aspects of the concept of fraudulent transactions. In addition, typical yet not decisive elements of fraudulence are highlighted and described such as the intention of deception of outsiders and types of motivation and motives leading to fraudulence. |
