520 3 |a Hunger strike is a common form of protest in prison settings and is also problematic because prisoners are in the custody of the state and the state (the prison administration) is entrusted with ensuring their health and lives. In addition, prison hunger strikes present clinical, ethical, legal and human rights challenges to doctors who care for hunger strikers: in caring for patients who are hunger striking the physician must balance the right of the hunger striker to refuse medical intervention and refuse medical intervention against the physician’s duty to preserve life. This article provides an in-depth analysis of the Declarations on hunger strikers (Declarations of Tokyo and Malta) and also elaborates on the European documents and case law of the European Court of Human Rights that are entirely or partly concerned with the issue of force-feeding prisoners on hunger strike. Finally, the study reveals that several countries in Europe still intervene in hunger strikes through the use of force-feeding to preserve the life of the prisoner on hunger strike.
