Tartalmi kivonat:As a result of adopting The Fundamental Law of Hungary the justice system can not remain unchanged. The press publishes news about courts and public prosecutor office every day, and the Parliament will soon discuss the cardinal laws in connection with these two main institutions of the jurisdiction. The social requirements against judges are high, even today it is referred as the peak of the legal career. In my opinion, the actuality of this theme is undoubted, but to the question whether the legislator has succeeded to make law that lead to judges who are better prepared professionally, is difficult to answer. Because of the sensitivity of this theme, only the minimum age limit is analyzing. The Paper seeks to demonstrate regulations of some European countries in connection with becoming a judge, the author tends to show the legislator’s allegged or real reasons of legal policy. Furthermore using foreign examples the author seeks to present what other alternatives would have been developed in line with national regulation being in force, if the age of 30 had not been introduced. Finally the Paper analyzes the issue that in Hungary there are not either age not professional requirements against administrative leaders of courts and the legislator does not tend to impose them contrary to several European countries.
