Tartalmi kivonat:The procedure against an absent defendent has been relatively untouched by the amendments of the legislator for a couple of years. In spite of that, the reason why I founded this special procedure interesting is a suprising case. It happened to K. S., a citizen from Kosovo, who was sentenced for six years imprisonent by a Hungarian local court. The police arrested K. S. who was forced to serve the sentence. He protested against the whole procedure and declared that he was not the same person who had been sentenced for the punishment. At the end of the retrial procedure the court determined that K. S. was innocent. The real defendent had a forged passport with false personal particulars and the criminal procedure was conducted in his absence. Now K. S. has a claim against the State of Hungary for compensation. The provisions of the procedure against an absent defendent in the act of criminal procedure are absolutely conform to the international requirements and expectations. However, I have some concerns about this legal institution. It violates the principle of directness, even more, the danger of the due process of law and the computabilty of the procedure is hidden in it. My main questions are can we give up the principle of immediacy to punish the defendent and to demonstrate the power of the state? Why is it so important to have a symbolic sentence against the absent defendent? The total costs of this procedure are very high so why do we insist on this legal institution? My final conclusion is that the efficiency of the procedure against an absent defendent is highly doubtful so it should be reviewed by the legislator in the spirit of rationality.
