| Tartalmi kivonat: | The purpose of this study is to examine the question whether the license agreement – regarded as one of the most significant contract in today’s commercial sphere – has independent, typical contractual characteristics; and as a consequence of this, leaving out such type of contract from the new Civil Code is really established or not. Giving answer to the above question is possible only by means of revealing the content and features of the license agreement progressively. In the course of this, on the one hand the study examines whether this contract, which originally rooted in copyright acts and laws of protection of industrial property rights, can be picked out from such statutes or not; on the other hand such core of this contract exists or not which is suitable to be involved in the code, independent of the special rules of detail. In other words – and this can be considered as the most important aspect of investigation – does it have those typical contractual elements which establish to be appreciated as an independent type of contract. At the end of the investigation the conclusion can be drawn that by this time the theoretical and practical life has worked out the license agreement as the subject matter of this study, by right of its economic significance, insomuch that it possess those typical contractual elements which justify to be evaluated as an independent type of contract, and hereby to be involved in the new civil code. |
