520 3 |a The Hungarian citizen of Serbian origin following a seven-year-long procedure turned to the European Court of Human Rights since his right to respect to family life and privacy had been violated by the Hungarian authorities. Furthermore, he also claimed that the judgements of the courts were against Article 8 and 14 – freedom of religion and prohibition of discrimination. The Court concluded that there was no reasonable relationship of proportionality between the total ban on the father’s access rights and the aim pursued, namely the protection of the child’s best interest. Consequently, the father has been discriminated against on the basis of his religious convictions in the exercise of his right to respect for family life. This short study investigates not only the Court’s decision but also the case itself mainly placing the psychological and psychiatric experts’ opinions in focus, in order to reveal what exactly led to the total ban of father’s access right.
